Well, there are many crimes that do not get resolved, and may criminals that do not get prosecuted. However, a lawsuit has just been filed days ago asserting that the encryption is easily bypassed by the company, and that users have been deliberately misled about the security of their comments. There is at least an attempt being undertaken to hold Whatsapp to account and to improve the security of folks using messaging apps.
